Distribution Rules: Decision of the Federal Institute for Intellectual Property
The Federal Institute for Intellectual Property has approved the following amendments to SUISA's Distribution Rules:
Follow the respective link to the wording of the decisions, available in German only, however. The individual amendments to the Distribution Rules are published in German, French and Italian in the Swiss Official Gazette of Commerce (SHAB/FOSC).
“Elimination of Common Tariff 9 / Revision of Sections 5.1, 5.2, 5.5.8, 5.5.9, 5.5.10, 5.5.11, 5.5.12, 5.5.13 and 7.4 para. 2", published in the SHAB/FOSC of 30.10.2023.
Together with Common Tariff 8 (CT 8), Common Tariff 9 (CT 9) regulated internal uses in enterprises, public administrations and similar bodies within the meaning of Article 19(1)(c) in conjunction with Article 20(2) CopA. While CT 8 hitherto applied to “hard copies” for internal use, CT 9 applied to “digital copies”, i.e. uses in internal networks of organisations. Effective on 1 January 2023, CT 9 was incorporated into CT 8 which henceforth applies both to hard copies and digital copies; as a result, CT 8 has been renamed “Uses in organisations”. A number of changes now have to be made in the wording of SUISA’s Distribution Rules to take into account the merging of the two tariffs.
